Group threatens to sue Minister for appointing one person as board chairman of development commissions

A group, Arewa Youths for the Sustenance of Democracy and Good Governance (AYSDGG) has expressed dissatisfaction over the appointment of Hon. Lawal Sama’ila Abdullahi Yakawads as the board chairman of all the development commissions.

Last week, the Minister of Regional Development, Engr. Abubakar Momoh, announced the appointment of Hon. Lawal Sama’ila Abdullahi Yakawada in Abuja, saying that the appointee is a patriotic Nigerian whose wealth of experience would be instrumental in consolidating President Tinubu’s Renewed Hope Agenda.

“This appointment is a testament to Hon. Yakawada’s proven capacity for leadership and his deep commitment to national development. We are confident that under his stewardship, the commissions will work in unison to deliver transformative results for Nigerians,” the minister said.

While reacting in Bauchi on Monday, the group described the appointment as “illegal, unconstitutional” saying that it violated the act that established the Development Commissions.

The Coordinator of the group, Aliyu Musa Aliyu on behalf of the stakeholders of the group argued that the Commissions were established by law and until the acts are amended by the National Assembly, “no one has the power to go outside the act that established them.”

Aliyu explained the unilateral appointment of Chairman of Regional Development Commissions by the Minister, “without proper legal and constitutional authority, is ultra vires, unconstitutional, null and void.”

“Such appointments amount to a usurpation of Presidential and National Assembly powers under the 1999 Constitution (as amended) and the enabling Acts establishing the respective Commissions.

“The unilateral appointments violated the principles of separation of powers and due process under the Constitution of the Federal Republic of Nigeria, 1999 (as amended), and the action undermines transparency, federal character, and good governance.”

He noted that the enabling laws establishing the Regional Development Commissions vest appointment powers on the President subject to Senate confirmation, not the Minister.

Aliyu urged stakeholders like the National Assembly, the Nigerian Bar Association (NBA), security agencies, law enforcement agencies, the media, civil society organisations to defend the law.

He called on the minister to follow the path of honour and reverse his decision or else they will be left with no option but to challenge the matter through all legal means.

They appealed to President Bola Tinubu and the National Assembly to call the minister to order as a mark of respect to the rule of law.
